The new General Data Protection Regulation (GDPR) has been applicable since May 25th 2018. It means that one privacy legislation applies to every country in the European Union. The old legislation, the “Personal Data Protection Act”, will expire.
The new AVG legislation strengthens the position of people whose personal data are being processed. Not only do they receive new privacy rights, their existing rights also become a lot stronger. Organizations and companies that process personal data get more obligations. The focus will be on the responsibility and liability of organizations and companies to be able to demonstrate and substantiate that they are complying with the law.
In short, the new law tightens and extends privacy rights, more responsibilities for organizations and companies and equal powers for all European privacy regulators, such as the authority to impose fines of up to € 20 million.
